Election Contest Hearings:
Attorney for Judge Jason Cox (Probate court) says the contest is a financial & time burden but also puts into question the legitimacy of Judge Cox' position. Has a power point and will have "unorthodox" arguments.
Attorney Chris Feldman argues there are only 23,000 votes in question while his client won by 33,280 votes.
Feldman is saying contestant must produce names of those who voted illegally or whose votes were counted that should not have been. (Olsen's attorney is not arguing fraud but suppression according to complaint)
Cites other cases saying contestant must provide names of those deprived of right to vote.
Feldman says next part of his argument will be a bit of a "rabbit trail."
Is noting times of filing for each contestant (time county district clerk posted?) and noting time #txlege Sen Bettencourt announced filings and proposed new legislation.
Suggests his client is being used as "an unwitting prop" to help promote new legislation or to attack Harris County Election Administrator Clifford Tatum.
FYI: Feldman is representing Judge Cox, while Olsen is represented by Jared Woodfill. Woodfill has taken a different legal approach from candidates represented by Alvarez.
Woodfill says election contest is absolutely not an unwitting prop. Says Feldman hasn't really presented special exceptions.
Woodfill says Feldman is trying to make an "end-run" around Texas rules of civil procedure.
Judge overrules the request for special exceptions.
Judge says "We've got to see what the elections records show."
